Terms and conditions

§ 1 Scope

(1) These terms and conditions apply to all contracts for ICAO language tests, ICAO trainings and PreChecks between GAT – German Aviation Training, owner Tim Hittinger, Max-Planck-Straße 22, 72810 Gomaringen, Germany (“GAT”) and its customers (“customer”) in the version valid at the time of booking.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 German Civil Code).

(3) Deviating terms of the customer are not recognised unless GAT expressly agrees to them.

§ 2 Services

(1) GAT organises and conducts ICAO language tests (language proficiency assessment under FCL.055) as well as ICAO trainings and PreChecks online via Zoom. The language tests are conducted as the “ICAO Level” test of the language testing body LTB 112, which is certified and supervised by Austro Control GmbH. The second assessment and the issue of the certificate are carried out by LTB 112.

(2) The test result depends solely on the performance shown in the test. A particular level or passing is not owed. In the “Level 4 only” test, the highest level certified is Level 4.

(3) The language endorsement is entered in the licence by the authority competent for the customer. Its fees are not included in the price.

(4) Service descriptions on the website are for information and do not constitute a guarantee or warranty.

§ 3 Booking and conclusion of contract

(1) The presentation of services on the website is not a legally binding offer but an invitation to book.

(2) By completing the booking in the online calendar or online shop, the customer submits a binding offer. The subsequent automatic confirmation initially only documents receipt of the booking.

(3) The contract is concluded when payment by PayPal or credit card has been completed; for bank transfer, when the payment request is sent.

(4) If, for payment by bank transfer or invoice, the amount is not received within 10 calendar days of sending the confirmation, GAT reserves the right to cancel the booking.

(5) The language of the contract is German.

§ 4 Prices and surcharges

(1) All prices are final prices in euros and include statutory VAT.

(2) Surcharges on the base price apply to slots in the evening, at weekends and on public holidays in Baden-Württemberg. The amount of the surcharge and the total price are shown in the booking calendar before the booking is completed.

(3) Vouchers are only valid for GAT services and are credited against the base price, not against surcharges.

§ 5 Payment

(1) The following payment methods are available: bank transfer, credit card (via Stripe) and PayPal.

(2) With bank transfer, the slot is confirmed once payment has been received; with credit card or PayPal, immediately after payment.

§ 6 Slots, rescheduling and cancellation

(1) Tests, trainings and PreChecks take place online via Zoom. The customer receives the access details by email.

(2) Slots can be rescheduled or cancelled free of charge up to 24 hours before the start. After that, the full fee is due; no refund is made.

(3) If the customer does not appear in the Zoom meeting within 15 minutes of the agreed start, the entitlement to the service lapses. A refund is excluded.

(4) If the customer is prevented at short notice, for example by illness, they may name a substitute. This must be notified in text form no later than 12 hours before the slot.

(5) For discounted bundles, subsequent changes to or cancellation of individual components are excluded. Once the customer has used part of the bundle, cancellation of the remaining bundle is excluded. The statutory right of withdrawal remains unaffected.

§ 7 Recordings

Recordings of trainings and tests by the customer – in particular by video, audio, AI-supported text, shorthand or summarising systems – are prohibited unless GAT has given its prior written consent.

§ 8 Warranty and liability

(1) The statutory warranty rights apply.

(2) GAT is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health.

(3) In the event of a slightly negligent breach of material contractual obligations, GAT is only liable for foreseeable damage typical of the contract. Otherwise, liability for slightly negligent breaches of duty is excluded.

§ 9 Contract text

The contract text is stored by GAT and sent to the customer by email with the booking confirmation.

§ 10 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory consumer protection provisions of the state of their habitual residence.

(2) For consumers, the statutory place of jurisdiction applies. For merchants, the place of jurisdiction and performance is GAT’s registered office.

(3) GAT is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

(4) Should individual provisions be or become invalid, the validity of the remaining provisions remains unaffected.

Right of withdrawal

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (GAT – German Aviation Training, owner Tim Hittinger, Max-Planck-Straße 22, 72810 Gomaringen, Germany, phone +49 7072 1352530, email tim@german-aviation-training.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notice of exercising the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and at the latest within fourteen days from the day on which we received notice of your withdrawal from this contract. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement.

If you requested that the services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you informed us of the exercise of the right of withdrawal, compared with the total scope of the services provided for in the contract.

Early expiry of the right of withdrawal

For a contract for the provision of services, the right of withdrawal expires when we have fully performed the service and only began performance after you gave your express consent and at the same time confirmed your knowledge that you will lose your right of withdrawal once we have fully performed the contract.
